Crypto Stocks Split as Bitcoin Prints $86,396
Crypto stocks split after the Senate killed the Clarity Act, as Coinbase, Robinhood and Circle re-rate on the SEC’s tokenized-stock sandbox and bitcoin prints.
$86,396.74 was Coinbase’s bitcoin print on September 21, and listed crypto names moved with it. Circle, Coinbase, Robinhood, Strategy and Bitmine Immersion Technologies all finished higher on the same session.
The tape bundled those names into one bounce. Coinbase, Robinhood and Circle are being priced as plumbing for tokenized U.S. stocks, while Strategy and Bitmine still trade as leveraged bets on bitcoin and ether.
A 49-50 Vote and a Fast Reversal
On September 15, 2026, the Senate refused cloture on H.R. 3633, the Digital Asset Market Clarity Act, by a 49-50 vote. The motion needed 60. It missed by 11.
Senator Chris Coons did not vote. Susan Collins, Josh Hawley, Jerry Moran and Thom Tillis voted no with the Democratic caucus, and Tillis did so in order to file a motion to reconsider. Senate Banking Committee Chairman Tim Scott said nearly all Republicans had voted to advance the bill and that it was now time for the SEC and the CFTC to set clear rules of the road for digital assets until Congress legislates.
Bitcoin sold off with the vote. The St. Louis Fed’s Coinbase series then showed $76,366.40 on September 17, the day the Commission acted. Chairman Paul S. Atkins said Congress had been unsuccessful in advancing the CLARITY Act, then announced an order the Commission could issue under existing law.
Earlier this week, Congress was unsuccessful in advancing the CLARITY Act despite the tireless efforts of many. So today, the Securities and Exchange Commission is taking a significant step forward, within its statutory authority, to bring America’s capital markets into the digital age by facilitating onchain trading of certain tokenized stocks through the “Innovation Exemption.”
Paul S. Atkins, Chairman, U.S. Securities and Exchange Commission, September 17, 2026 statement
That sequence, a dead market-structure bill and a narrow substitute two days later, is what the stock bounce is actually pricing.
THE WEEK THAT FLIPPED THE TAPE
- September 15, 2026: Senate cloture on the Clarity Act fails 49-50, 11 votes short of 60.
- September 17, 2026: The SEC issues the Innovation Exemption for tokenized NMS stock; Coinbase bitcoin prints $76,366.40.
- September 18, 2026: Coinbase rises 11.7% to $194.25, Strategy 16.4% to $153.92, Robinhood 9.1% to $119.82 and Circle 7.9% to $91.78.
- September 21, 2026: Strategy and Bitmine file treasury updates, and Coinbase bitcoin prints $86,396.74.
Friday’s session already re-rated the platforms on the order itself, before bitcoin cleared $86,000. Monday added the treasury headlines and the Coinbase Bitcoin price of $86,396.74, up 6.3% from $81,253.37 on September 20.
The SEC Issued a Five-Year Workaround
Release 2026-90 grants temporary, conditional exemptive relief under Section 36(a)(1) of the Exchange Act. Tokenized Securities Venues, or TSVs, get relief from the definition of “exchange.” Certain liquidity providers, called Covered Firms, get relief from the definition of “dealer.”
Jamie Selway, director of the Division of Trading and Markets, called the approval a milestone for opening capital markets to tokenized securities and said the division would work with parties that want to operate a TSV. The relief runs five years after publication and asks for public comment on changes.

A TSV is a U.S. person that runs permissioned automated market maker pools in tokenized National Market System stock on a public, permissionless ledger. It is not a full exchange registration, and it is not the Clarity Act. Anti-fraud rules still apply in full, Atkins said.
RULES FOR A TOKENIZED VENUE
- Same rights: Tokens must give holders the same privileges as the listed share, including dividends and voting.
- No synthetics: Price-only lookalikes that do not carry those rights do not qualify.
- Issuer objection: Before listing a third-party token, the venue must notify the issuer and give it a chance to block the listing.
- Launch notice: A TSV must post a public notice at least 30 days before it starts operating.
- Halt mirror: Token trading must stop when the primary listing exchange halts the underlying stock.
- Open code: Smart contracts must be auditable, public and deployed on a public permissionless ledger.
Those conditions are why Goldman Sachs analysts could name three listed crypto names as early beneficiaries without claiming the whole sector had just been legalized. The order lets a permissioned pool trade a capped slice of U.S. stocks onchain. It does not assign the SEC and the CFTC their lanes for bitcoin, ether or stablecoins, which is what H.R. 3633 was written to do.
Who Gets Paid if Tokenized Stocks Trade?
Goldman Sachs and Citizens analysts pointed to Coinbase, Robinhood and Circle. Coinbase already sells tokenized-equity products that, the Goldman note said, carry many of the rights the order requires, and it has custody, a tokenization unit and the Base chain as extra ways to charge for the same flow. Circle is in the conversation because USDC is an obvious settlement and collateral coin if those pools clear in dollars onchain.
Robinhood is the awkward fit. Its overseas stock tokens give price exposure through a derivative structure and do not hand the holder the listed share’s legal rights, so they sit on the wrong side of the “no synthetics” line. The firm still backed the order in public, arguing Americans should get instant settlement, around-the-clock trading and fractionalization by default.
Robinhood supports the @SECGov innovation exemption.
Americans deserve access to crypto technology and all of the financial innovations it makes possible, including instant settlement, 24/7 trading, and fractionalization by default.

That product gap is the tell. A broker can cheer the exemption and still have to rebuild the thing it already sells if it wants U.S. volume under this order. Strategy and Bitmine do not have that problem, because they are not trying to be TSVs. They hold coins. When bitcoin and ether rise, their equity rises, exemption or not.
MONDAY’S FIVE CRYPTO STOCK PRINTS
| Stock | Monday price | Monday move | What is being priced |
|---|---|---|---|
| Circle (CRCL) | $94.75 | over 3% | USDC as onchain settlement |
| Robinhood (HOOD) | $123.21 | nearly 3% (five-day around 8%) | U.S. tokenized stocks, if it rebuilds |
| Coinbase (COIN) | $205.09 | more than 5.5% | custody, Tokenize, Base, trading |
| Strategy (MSTR) | $166.35 | more than 8% | 846,000 bitcoin, not TSVs |
| Bitmine (BMNR) | $27.43 | about 6% (30-day 21%) | ether treasury toward 5% |
Circle’s Monday gain looks small next to Coinbase, which is the cleaner listed bet on trading, custody and issuance rails. Robinhood’s five-day run around 8% is the market paying for optionality it has not yet built.
950 Bitcoin Came After a $174 Million Buyback
Strategy’s Form 8-K filed September 21 shows the company bought 950 bitcoin between September 14 and September 20 for $75.7 million, or $79,670 a coin including fees. It was the first purchase in three weeks and was paid from USD Cash, not from fresh at-the-market equity.
The stack is now 846,000 BTC, acquired for $63.8 billion at an average $75,416. That is 1,363 bitcoin shy of the 847,363 coins reported on June 22. USD Reserve was $5.04 billion as of September 20 and USD Cash was $1.05 billion, after $57.4 million went to preferred dividends and interest.
WHERE THE CASH WENT
- Bitcoin buy: $75.7 million for 950 BTC from existing cash.
- STRC buybacks: $174 million of the variable-rate preferred, more than twice the bitcoin ticket.
- Carry: $57.4 million for preferred dividends and debt interest.
- ATM: No common or preferred shares sold under the at-the-market programs that week.
The larger check was the preferred stock, not the coins. Strategy is still a bitcoin proxy, and an 8% up day on a $86,396.74 Coinbase print is exactly how that proxy is supposed to trade. It is not a TSV story. Michael Saylor’s firm gets paid if bitcoin holds, whether or not anyone ever posts the 30-day notice to open a tokenized-stock pool.
Bitmine’s Stack Is 4.9% of Ether
Bitmine Immersion Technologies, the listed ether treasury chaired by Fundstrat cofounder Tom Lee, said it bought 27,562 ETH last week, about $75.2 million at $2,727. That weekly lot is not the supply figure. The company now holds 5,983,940 ETH, which is 4.9% of a 122.1 million ether supply, and it is still chasing a 5% target.
Combined crypto, cash and other holdings were put at $17.1 billion. Bitmine has bought ether every week since it launched the treasury plan on June 30, 2025, and BMNR’s 30-day gain of 21% is that program showing up in the stock. Lee said large institutions remain “underweighted” in crypto and that he expects them to add in the last three months of 2026.
Jeremy Allaire, Circle’s chief executive, struck a similar note after the Senate vote, saying industry in the U.S. and around the world continues to march on and that policy responds to what is already happening in the real economy. That is the treasury-and-stablecoin reading of the week: coins kept clearing even while the market-structure bill died.
Tier 1 Names Face a 0.25% Volume Cap
The order is small on purpose. Skadden’s note on the exemption says a TSV may list 75 symbols and a 0.25% volume cap for Tier 1 names, which are S&P 500 and Russell 1000 stocks plus certain exchange-traded products, measured against the prior month’s average daily share volume. Tier 2, all other eligible NMS securities except rights and warrants, allows 250 symbols and 2.5% of that average.
THE TWO TIERS
| Tier | What can trade | Symbol limit | Volume cap |
|---|---|---|---|
| Tier 1 | S&P 500, Russell 1000, named ETPs | 75 | 0.25% of prior-month ADV |
| Tier 2 | Other eligible NMS stock | 250 | 2.5% of prior-month ADV |
A venue that stays inside those bands is exempt from exchange registration and is not treated as a Regulation NMS market center, Skadden wrote, which is the legal trick that makes an AMM pool possible. Issuers still get 30 days to object to a third-party token, a separate clock from the 30-day public notice a TSV must post before it opens. Until someone posts that notice, the exemption is a permission slip, not a market.
Onchain venues are already lining up to look like U.S. persons who can live with OFAC, public code and those caps. The stock market did not wait. It paid Coinbase, Robinhood and Circle for a five-year sandbox, paid Strategy and Bitmine for more coins, and left the Clarity Act on the calendar with a reconsider motion and no 60 votes in hand.
