Agreement to these terms

These terms govern your use of cumbernauld-media.com and any newsletter, alert or feed Cumbernauld Media publishes from it. By using the site you agree to them. If you do not agree, the remedy is simple and free: do not use the site. We have written them in plain language because a reader checking a score, a fare or an election result should not need a lawyer to know what they agreed to by reading the news.

Who we are

Cumbernauld Media is an independently owned and operated news publisher with an international, English-language readership and no single home city or country of focus. We run ten desks: world news, business, technology, science, sports, entertainment, lifestyle, travel, auto and gaming. Our editorial policies, ownership and funding are described on their own pages, which are not part of this legal agreement.

Using the site

You may read, link to and share our articles for personal, non-commercial purposes. You may quote short passages with attribution to Cumbernauld Media and a link to the original. You may not reproduce whole articles, systematically copy or scrape the site, republish our content on another site or service, or use our content to build datasets or train automated systems, without our written permission. Ordinary search-engine indexing is fine; bulk collection is not.

You agree not to interfere with the operation of the site, probe or breach its security, submit material designed to impersonate others or to deceive, or use the site for any unlawful purpose. We may block access from any source we believe is abusing the site, without notice.

Our content

The articles, headlines, photographs, graphics, design and code of this site belong to Cumbernauld Media or to the licensors who have allowed us to use them. The name Cumbernauld Media and the site’s visual identity are ours, and using them in a way that suggests we endorsed or produced something we did not is not permitted. Public documents we reproduce remain public; our presentation of them is ours.

What you send us

When you send us a tip, a letter, a document, a photograph or any other material, you keep the copyright in it. You grant us a non-exclusive, worldwide, royalty-free licence to publish, edit, excerpt and archive it in connection with our journalism, in any format. You confirm that you have the right to send it and that publishing it will not infringe anyone else’s rights. We are not obliged to publish anything you send, and we may edit anything we do publish. Material sent in confidence is handled under the rules on the contact page, which take priority over this paragraph where they conflict.

If comments or other public contributions are enabled, you are responsible for what you post. We may remove anything unlawful, defamatory, threatening, discriminatory, commercial or simply off the subject, and we may bar people who repeatedly post such material. We do not pre-screen contributions and we are not their publisher.

Advertising

Advertisements on the site are labelled and are served through a third-party advertising network. We do not publish sponsored posts, paid links or guest posts. We are not a party to any transaction between you and an advertiser, and we make no promises about advertisers’ products or services. Links to other sites

Our stories link to source documents, official sites, results, filings and other material where it helps you check our work. We do not control those sites and are not responsible for their content, accuracy or privacy practices. Linking to something is citing it, not vouching for it.

No advice and no warranty

We work to be accurate and we correct errors quickly, as the corrections policy describes. But news is produced under time pressure, prices and schedules move after publication, and products change between announcement and sale. Nothing on the site is financial, investment, medical, legal, travel, purchasing or other professional advice, and nothing on it creates a professional relationship between you and us. The site is provided as it is and as it is available, without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose or uninterrupted availability. Limitation of liability

To the fullest extent the law allows, Cumbernauld Media and the people who work on it are not liable for any indirect, incidental, consequential, special or punitive damages arising from your use of the site or your reliance on anything published on it, including lost profits, lost data, missed travel, trading losses or business interruption. Where liability cannot be excluded, it is limited to the amount you paid us to use the site, and reading the site costs nothing. Some jurisdictions do not allow certain limitations, and in those places these limits apply only as far as the law permits.

If you send us material that infringes someone’s rights, or use the site in a way that breaks these terms and causes a claim against us, you agree to cover the costs and damages that result, including reasonable legal fees.

Copyright complaints

If you believe material on the site infringes your copyright, follow the process on the DMCA page. It sets out what a notice must contain and what happens next, and it applies to notices under equivalent laws outside the United States.

Governing law and disputes

These terms are governed by the laws of the jurisdiction in which the publisher of Cumbernauld Media is established, without regard to conflict-of-law rules, and disputes arising from them will be brought in the courts of that jurisdiction. We confirm which jurisdiction that is, together with our registered details, in writing to anyone with a legitimate need to know; write to support@cumbernauld-media.com with LEGAL in the subject line. If you are a consumer in a place whose law lets you sue where you live, nothing here removes that right. Before filing anything, write to us; most disputes with a news site turn out to be correction requests, and those are settled quickly.

Changes and termination

We may update these terms. The date at the top of the page changes when we do, and a material change is announced on the site before it takes effect. Continuing to use the site after that date means you accept the updated terms. We may suspend or end access to the site, or any part of it, at any time.

General

If any part of these terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the privacy policy and cookie policy, are the whole agreement between you and us about the site.
